Conditions of Use

1. Payment
All payments by Credit/Debit Cards are entirely by a secure payment provided by Banque CIC. For all payments on line the bank details stay confidential.

2. Pricing
All the prices are shown in Euros including the current French VAT and other taxes. Price given does not include transport costs. The company reserves the right to modify the prices at any time. However the prices will be invoiced at the current price at the time of receiving the order.

3. Delivery
At present the company will only delivery within mainland France. After confirmation and verifying the availability of the products ordered the company will employ a transport company or La Poste to deliver all the references ordered by the buyer. The delivery will be completed within the timeframe the customer was informed. Any eventual delays do not give the buyer the right to cancel the sale, refuse the merchandise or claim damages and interest. The customer will be informed the day of delivery by email or by telephone. If the customer is absent when the delivery is made the courier will leave notification of the attempted delivery. The customer must then arrange with the courier another time to deliver the goods. The customer is unable to cancel the order because of non-delivery in the case where the customer is absent. In this case the customer can not claim damages and interest nor refuse the delivery. The delivery address is specified on the order form that the customer confirms. The company can not beheld responsible for all failings if the delivery address is erroneous. The customer should verify the goods have arrived in the presence of the courier in order confirm that there are no broken bottles and that the order conforms to the order form. After delivery note is signed the customer can not claim against broken bottles or non-conformity to the order.

4. Protection of Minors
Conforming to current law (article L.3342-1 Public Health that states that selling alcohol to minors less than sixteen years old is forbidden, the buyer accepts that when completing the order form that he/she is sixteen years or older at the time of completion.

5. Freedom of Information
Under article L.3342-1 (6th January 1978) freedom of information, the customer has the right to access, change and withdraw all personal data. The customer can exercise this right by written correspondence to: Blakeney Wines SARL, 13 Place du Marché, 62132 Hardinghen.

6. Reserved rights and applicable legislation
Conforming to current law (80335 12 May 1980) the products remain the property of the company until full payment of the order is completed. The products will not be despatched to the customer until the company is in receipt of the full payment for the order. These present general conditions and terms of sales are governed by French law. If a dispute arises, blakeneys and the customer will do their best to find an agreement outside the courts. Failing this agreement, the contract will come within the jurisdiction of the Trade court of Boulogne. Whatever delivery address and the way of payment agreed and with the possibility by blakeneys to refer the contract to another court of competent jurisdiction.

7. Product availability
If a product is out of stock the company will replace the product ordered by another product from the same region and of the same or another year and of a value equal or superior to the unavailable bottle. In this event the company will ask for the customer’s agreement prior to dispatch of order. The customer is entitled to refuse the suggested product in which case a full refund will be made.
